New decision of the Federal Court of Justice: E-commerce traders have to provide clear information about VAT and transport costs on their homepage

The German Federal Court of Justice decided on the 4th of October 2007 (file number: I ZR 143/04) that consumers have got the right to receive clear and easily accessible information about VAT and transport costs on the homepage of the trader when shopping online.

A German internet trader provided information about tax and costs for transportation only in the general terms and conditions and not directly on the homepage. A competitor sued the company and the Federal Court of Justice now decided in favour of the claimant.

The Federal Court of Justice though decided in contrary to the prior instances that the information does not necessarily have to be given on the same page where the product is offered. According to the court it is sufficient if the information is given easily accessible and noticeable on another webpage before the consumer finally orders the requested good.
